TEESSIDE MOTORSPORTS – TERMS & CONDITION
1. General Terms
Teesside Motorsports / Teesside Karting Ltd (“the Company”) provides motorsport activities, events, catering, hospitality and venue hire.
By making a booking, attending the venue, or participating in any activity, you confirm that you have read, understood and agree to be bound by these Terms & Conditions in full.
These Terms & Conditions apply to all customers, participants, spectators and any individuals attending the venue.
The Company reserves the right to amend these Terms & Conditions at any time. The latest version will always be available on the Company website and will apply to all bookings and attendance.
2. Formation of Contract
A legally binding contract between the Customer and the Company is formed when:
- A booking is completed via the Company’s online booking system
- A booking is made in person at the venue
- A booking is made over the telephone and confirmed by the Company
- Payment (full or partial) is received
By making a booking, the Customer confirms that:
- They have read and accepted these Terms & Conditions
- They have the authority to make the booking on behalf of all participants included
- They accept responsibility for communicating these Terms & Conditions to all participants within their booking
These Terms & Conditions apply to all individuals associated with the booking.
3. Payment Terms
All bookings require payment either in full or in part as specified at the time of booking.
Where a deposit is required:
- The deposit must be paid within the stated timeframe
- The booking will not be secured until payment is received
Where a balance is due:
- The remaining balance must be paid within the timeframe specified by the Company
- Failure to pay may result in cancellation of the booking and loss of deposit
The Company reserves the right to:
- Cancel bookings where payment has not been received
- Refuse service where payment terms are not met
- Charge for any additional services, time or resources used beyond the agreed booking
4. Payment Methods & Security
Payments may be made via:
- Online booking systems
- Card payments in person or over the phone
- Bank transfer where agreed
All card payments are processed securely via third-party payment providers including Stripe and Worldpay.
The Company:
- Does not store full card details
- Uses secure, PCI-compliant payment gateways
- Takes reasonable steps to ensure payment security
The Customer acknowledges that:
- Payment processing is handled by third-party providers
- The Company is not liable for failures, errors or breaches within those systems
5. Pricing & Errors
All prices are correct at the time of booking but may be subject to change.
In the event of a pricing error, the Company reserves the right to:
- Correct the price
- Contact the Customer to confirm acceptance of the corrected price
- Cancel the booking if the corrected price is not accepted
6. Chargebacks & Payment Disputes
Customers must contact the Company directly to resolve any issues before initiating a chargeback.
Where a chargeback is initiated without reasonable cause, the Company reserves the right to:
- Recover any associated costs or fees
- Cancel the booking
- Refuse future bookings
7. Cancellations & Amendments
Bookings are non-refundable unless explicitly stated otherwise.
Requests to amend bookings:
- Must be made as early as possible
- Are subject to availability
- Are not guaranteed
Late arrival may result in:
- Reduced track time
- Refusal to participate
The Company reserves the right to cancel or amend bookings due to:
- Weather conditions
- Safety concerns
- Operational requirements
Where possible, alternative dates or credit may be offered at the Company’s discretion.
8. Participation & Safety
All participants must:
- Follow all instructions given by staff and marshals
- Attend and listen to all safety briefings
- Wear appropriate safety equipment and clothing
The Company reserves the right to:
- Refuse participation to any individual
- Remove any participant who is deemed unsafe or unsuitable
Safety is the priority at all times.
9. Liability
Motorsport activities carry inherent risks.
By participating, individuals accept that:
- They take part entirely at their own risk
- The Company is not liable for injury, loss or damage except where required by law
Personal belongings are brought on site at the owner’s risk.
10. ADDITIONAL OPERATIONAL & LEGAL TERMS
10.1 Damage to Equipment & Property
Motorsport activities involve normal wear and tear and incidental contact. Minor or accidental damage is typically covered by the Company as part of normal operations.
However, the Customer accepts responsibility for damage resulting from:
- Reckless or dangerous behaviour
- Failure to follow staff instructions or flag signals
- Deliberate actions
- Negligence or misuse of equipment
In such cases, the Company reserves the right to:
- Charge for repairs, replacement parts and labour
- Recover costs for damage to karts, vehicles, barriers, buildings or equipment
- Recover costs for operational downtime caused by the damage
Where multiple participants are involved, the lead booker or team entrant remains responsible for all associated costs.
The Company’s decision as to whether damage is accidental or due to reckless or negligent behaviour shall be final.
10.2 Behaviour & Conduct Policy
All individuals must behave in a safe and respectful manner.
The following will not be tolerated:
- Dangerous or reckless driving
- Ignoring staff or marshal instructions
- Verbal or physical abuse
- Aggressive or threatening behaviour
- Deliberate damage to property
The Company reserves the right to:
- Remove individuals or groups immediately
- Disqualify participants
- Refuse future bookings
No refund will be given in these circumstances.
10.3 Late Arrival & No-Show Policy
Customers must arrive in sufficient time to complete:
- Signing-on
- Safety briefing
- Equipment preparation
Late arrival may result in:
- Reduced participation
- Refusal to take part
No-shows will result in:
- Loss of booking
- No refund or transfer
10.4 Owner Driver & Participant Liability
Participants in owner driver or competitive events are responsible for:
- The safety and condition of their equipment
- Compliance with all regulations
The Company is not responsible for:
- Mechanical failure
- Damage to personal equipment
- Loss of equipment
10.5 Fuel, Engines & Technical Compliance
All equipment must comply with event regulations.
The Company reserves the right to:
- Inspect, test or seal equipment
- Exclude non-compliant equipment
Any attempt to gain unfair advantage may result in:
- Disqualification
- Removal from the event
- No refund
10.6 Force Majeure
The Company shall not be liable for failure or delay due to events beyond its control, including:
- Weather conditions
- Mechanical failures
- Government restrictions
- Utility failures
The Company may cancel, delay or amend events as necessary.
10.7 Event Format, Timing & Operational Changes
The Company reserves the right to:
- Adjust event timings
- Change formats
- Alter track layouts
for safety or operational reasons.
10.8 Safety Compliance & Removal
Participation requires:
- Completion of signing-on
- Attendance at briefings
- Compliance with safety instructions
Failure will result in removal without refund.
10.9 Personal Injury & Insurance
Motorsport is a high-risk activity.
The Company:
- Holds public liability insurance
- Does not provide personal accident insurance
Participants are responsible for their own cover.
10.10 Spectators & Children
Parents and guardians are responsible for supervising children at all times.
Unsafe behaviour may result in removal from site.
10.11 Banning & Refusal of Entry
The Company reserves the right to refuse entry or ban individuals for safety or conduct reasons.
10.12 Entire Agreement
These Terms & Conditions form the entire agreement between the Customer and the Company.
11. Data Protection & GDPR
The Company complies with the UK General Data Protection Regulation.
Data collected includes customer and booking information.
Data is used for:
- Booking management
- Safety compliance
- Communication
Customers have rights to access, amend or request deletion of their data.
12. BUSINESS TO BUSINESS (B2B) BOOKINGS – FULL TERMS (TSK)
These terms apply to all corporate, group, hospitality and business-related bookings made with TSK (Teesside Karting Ltd).
12.1 Booking Confirmation & Deposit
- A 50% non-refundable deposit is required within 7 days of the provisional booking being made.
- Bookings are not confirmed until the deposit has been received by TSK.
- If payment is not received within this timeframe, TSK reserves the right to:
- Cancel the provisional booking
- Release the date and time to other customers
12.2 Final Balance Payment
- The remaining balance must be paid in full:
- No later than 7 days prior to the event, unless otherwise agreed in writing
- Failure to pay the balance may result in:
- Cancellation of the booking
- Loss of deposit
- Refusal of participation on the day
12.3 Booking Confirmation & Event Details
- A booking confirmation will be issued via TSK’s booking system.
- This confirmation will include:
- On-track activity times only
- The Customer acknowledges that:
- On-track time refers strictly to the allocated circuit time
- All additional activities take place outside of this time
12.4 Off-Track Activities & Event Duration
All bookings include mandatory off-track activities, which take place prior to track time, including:
- Signing-on
- Safety briefing
- Changing into equipment
- These activities typically require:
- 45 minutes to 1.5 hours, depending on group size and event complexity
The Customer is responsible for ensuring all participants arrive in sufficient time to complete these processes.
12.5 Additional Services (Hospitality, Catering, Extras)
Where additional services are included, such as:
- Food and drink
- Hospitality packages
- Meeting or briefing space
- These will:
- Take place before or after the on-track activity
- Be confirmed separately via email or written communication
- Timings for these services are approximate and may vary depending on operational requirements.
12.6 Amendments to Bookings
- The Customer has 24 hours from receipt of the booking confirmation to request amendments to:
- Date
- Time
- Booking details
- After this period:
- No changes are guaranteed
- Any amendments are strictly subject to availability
- TSK reserves the right to refuse amendments where:
- The requested slot is no longer available
- Operational constraints prevent changes
12.7 Changes to Numbers (Participants)
- Final participant numbers should be confirmed at least 7 days prior to the event
The following applies:
- Reductions in numbers may still be charged at the original booking value
- Increases in numbers:
- Are subject to availability
- May incur additional charges
TSK will make reasonable efforts to accommodate changes but does not guarantee availability.
12.8 Arrival & Timeliness
- All participants must arrive at the agreed time stated in booking communications
- Failure to arrive on time may result in:
- Loss of track time
- Reduction in event duration
- Cancellation of participation
No refund or compensation will be given for late arrival.
12.9 Customer Responsibility
The person making the booking (“the Booker”) is responsible for:
- Ensuring all participants:
- Are aware of these Terms & Conditions
- Arrive on time
- Follow all safety and conduct rules
- Acting as the primary point of contact for TSK
The Booker accepts full responsibility for:
- The conduct of all participants
- Any damage caused by participants
- Any failure by participants to comply with instructions
12.10 Conduct & Behaviour
All participants must behave in a safe and respectful manner.
TSK reserves the right to:
- Remove any individual or group for:
- Unsafe behaviour
- Disruptive conduct
- Failure to follow instructions
No refunds will be given where removal occurs due to behaviour.
12.11 Alcohol & Substance Policy
- Participants must not take part under the influence of alcohol or drugs
- TSK operates a zero-tolerance policy
- TSK reserves the right to:
- Refuse participation
- Remove individuals from site
No refund will be given.
12.12 Event Changes & Operational Control
TSK reserves the right to:
- Adjust timings
- Change event format
- Modify session structure
- Alter track configuration
- This may be necessary due to:
- Safety requirements
- Weather conditions
- Operational constraints
No compensation will be provided for such changes.
12.13 Cancellation by the Customer
- All B2B bookings are non-refundable
- Where a booking is cancelled by the Customer:
- The deposit is forfeited
- Additional charges may apply depending on notice given
- TSK may, at its discretion, offer:
- Credit
- Alternative dates
12.14 Cancellation by TSK
TSK reserves the right to cancel or postpone bookings due to:
- Extreme weather
- Safety concerns
- Operational issues
- In such cases, TSK may offer:
- Alternative dates
- Credit
Refunds will be at TSK’s discretion.
12.15 Liability & Risk
All motorsport activities carry inherent risk.
The Customer acknowledges that:
- Participation is at their own risk
- TSK is not liable for injury, loss or damage except where required by law
12.16 Agreement
By confirming a booking, the Customer agrees to:
- These Terms & Conditions
- All operational and safety requirements set by TSK
For the avoidance of doubt, booking times refer strictly to track usage and not total time on site.
13. 24 Hour & Endurance Events
- Entries must be paid as agreed
- Team entrant is responsible for all members
The Company may amend events and enforce penalties.
Entries are non-refundable.
14. Health & Fitness to Participate
Participants confirm they are medically fit and not under the influence.
The Company may refuse participation.
15. Signing-On & Declarations
All participants must complete required documentation.
Failure results in refusal without refund.
16. Clothing & Safety Equipment
Appropriate clothing must be worn.
Failure may result in refusal.
17. Alcohol & Substance Policy
Zero tolerance policy applies.
18. Media & Photography
Participants consent to media use for promotional purposes.
19. Complaints Procedure
Complaints must be submitted in writing.
20. Governing Law
These Terms are governed by the laws of England and Wales.
21. Age, Height, Weight & Participation Restrictions
All participants must meet the minimum requirements for the activity booked.
These requirements may include, but are not limited to:
- Minimum age restrictions (which vary depending on activity and kart type)
- Minimum height requirements to safely operate a kart or vehicle
- Maximum height and/or weight limits due to equipment design and safety constraints
The Customer and/or lead booker is responsible for ensuring that all participants meet these requirements prior to attending.
TSK reserves the right to:
- Refuse participation to any individual who does not meet the required criteria
- Refuse participation where, in the opinion of TSK staff, a participant cannot safely operate or fit within the equipment
This includes, but is not limited to:
- Individuals below minimum age or height requirements
- Individuals whose height prevents safe control of the kart
- Individuals whose weight or size exceeds safe operational limits
Important Conditions
- No refund or compensation will be provided where a participant is unable to take part due to not meeting these requirements
- TSK accepts no responsibility for incorrect assumptions made by the Customer regarding eligibility
Final Authority
The final decision on whether a participant is able to safely take part rests with TSK staff on the day.
